This is an Agreement between You, the hirer, whose particulars are entered in this agreement, and Jupiter Campers Limited, the owner to rent the Vehicle. You (including a Joint Renter and any Authorised Driver) are jointly and severally responsible for compliance with the terms of this Agreement.
VEHICLE DESCRIPTION
- The owner will let and the hirer will take on hire the motor vehicle described in this agreement.
DURATION OF HIRE
- The terms of hire will be for the period described in this agreement. Refunds are not available if the vehicle returned earlier than agreed.
DRIVERS
- The vehicle may be driven during the period of hire only by the hirer or authorised driver as described in this agreement and only if each such person holds a current and valid overseas or New Zealand full driver licence (with English translation if required) that is appropriate for the class of Vehicle.
PAYMENTS BY HIRER
- The hirer shall pay to Jupiter Campers Limited as payment for the hire of the vehicle for the period of time referred to in clause 2 of this agreement. The sum as specified in this agreement.
- The hirer needs to pay 3% service fee for any credit card transactions.
- The hirer shall pay for all fuel used in the vehicle during the period of hire.
- The hirer shall pay for LPG gas used during the period of hire.
- The hirer shall pay for any toll road charges.
HIRERS OBLIGATIONS
- The hirer shall ensure that:
- the water in the radiator and battery of the vehicle is maintained at the proper level.
- the oil in the vehicle is maintained at the proper level
- the tyres are maintained at their proper pressure.
- The hirer shall ensure that all reasonable care is taken in handling and parking the vehicle and that it is left securely locked when not in use.
INSURANCE
- Subject to the exclusions set out below, the hirer and any driver authorised to drive the vehicle is fully indemnified in respect of any liability he or she might have to Jupiter Campers Limited in respect of the loss of or damage to the vehicle and its accessories and spare parts and any consequential loss of revenue or other expenses of the owner including towing and salvage costs associated with the recovery of the vehicle and its’ accessories and spare parts.
Subject to the exclusions set out below the hirer and any driver authorised to drive the vehicle are indemnified to the extent of $250,000 in respect any liability he or she might have for damage to any property (including injury to any animal) belonging to any other person and arising out of the use of the vehicle.
The hirer, any Joint Renter and any authorised driver authorises Jupiter Campers to debit the credit card/s provided at the commencement of the rental for the agreed upon insurance excess.
EXCLUSIONS
The indemnities referred to above shall not apply where the damage injury, or loss arises when:
- anyone whose blood alcohol concentration or level of drugs exceeds the percentage permitted by law;
- anyone who has given, or for whom You have given, a false name, age, address or driver’s licence details;
- anyone whose driver’s license has been cancelled or suspended within the last three years;
- anyone who is a learner driver, a provisional or probationary license holder or has not held a full driver’s licence for any class of vehicle for at least one year;
- anyone under 21 years of age; or
- anyone who uses or intends to use the vehicle for illegal purposes;
- The vehicle is in an unsafe or unroadworthy condition that arose during the course of the hire and that caused or contributed to the damage or loss and the hirer or driver was aware or ought to have been aware of the unsafe or unroadworthy condition of the vehicle.
- The vehicle is operated in any race, speed test, rally or contest.
- The vehicle is willfuly, carelessly or recklessly damaged by the hirer or any other person named in clause 3 of the agreement a, driving the vehicle under the authority of the hirer or is lost as a result of its willful, careless, reckless behavior.
- The vehicle is operated on any of the following roads: Skipper Canyon, any New Zealand beach roads (driving on the beach), Ball Hutt road at Mt Cook.
- The vehicle is operated outside the term of the hire or agreed extension of that term.
Is agreed between the Jupiter Campers and the Hirer that section 11 of the insurance law reform act 1977 shall apply with respect to the above exclusions as if this clause constituted a contract of insurance.
The Hirer acknowledges that he is aware of the above exclusion. And further:
- REJECTION OF INSURANCE
(clause 12 should be deleted if the hirer chooses to accept the insurance cover in clause 11)
The hirer accepts that the vehicle is hired to the hirer at the hirer’s own risk in respect of loss or damage to the vehicle and consequential loss by the owner. The hirer accepts that he or she may be liable to the owner for any loss or damage to the vehicle and consequential loss. The hirer, any Joint Renter and any Authorised Driver authorises Jupiter Campers to debit the credit card/s provided at the commencement of the rental for any of the charges in respect of loss or damage to the vehicle.
The hirer accepts that he or she has no cover under this agreement in respect of any damage, injury or loss caused to any person or property.
- Any broken glass, headlamps and windscreens are the hirer’s liability for the full costs repairs or replacement.
- Overhead and underbody: all damage above the level of the drivers cabin and the underbody of the vehicle is the hirers liability for the full costs or repairs.
OWNERS OBLIGATIONS
- The owner shall be responsible for all ordinary and extraordinary costs of running the vehicle during the term of the hire except to the extent that by the terms of this agreement those costs are payable by the hirer.
The owner must give you at least one copy of the agreement. A copy must be kept in the vehicle and produced on demand by any police officer or authorised employee of the ministry of transport.
In the unlikely event of a mechanical problem, repair costs will be borne by Jupiter Campers as outlined in the rental agreement. However, in the event of an accident or breakdown Jupiter Campers does not accept any responsibility for the cost of accommodation. Jupiter Campers liability is limited to the refund of hirer charges only for the loss of vehicle use.
MECHANICAL REPAIRS AND ACCIDENTS
If the vehicle is damaged or requires repair or salvage, weather because of an accident or breakdown, the hirer shall advise Jupiter Campers by telephone as soon practicable.
The hirer shall not arrange or undertake any repairs or salvage without the authority of the owner except to the extent that the repairs are necessary to prevent further damage to the vehicle or to other property.
The hirer shall ensure that no person shall interfere with the distance recorder or speedometer or, except in an emergency, any part of the engine, braking, or suspension systems of the vehicle.
USE OF THE VEHICLE
The hirer shall not use or permit the vehicle to be used for the carriage of passenger for hire or reward unless the vehicle is hired with the knowledge of the owner for use in a passenger service licensed under part 7.v11 of the transport act 1962 or exempted from licensing under that act.
The hirer shall not:
- Sublet the vehicle to any other person.
- Permit the vehicle, to be operated outside his or her authority.
- Operate the vehicle, or permit it to be operated in circumstances that constitute an offence by the driver against section 58 of the transport act 1962 (which relates to driving or attempting to drive with excess breath or blood alcohol or under the influence of drink or drugs).
- Operate the vehicle, or permit it to be operated in any race, speed test, rally or contest.
- Operate the vehicle, or permit it to be operated to propell or tow any other vehicle.
- Operate the vehicle, or permit it to be operated in breach of the transport act 1962 the traffic regulations 1976 or any other act, regulations, or by-laws to road traffic.
- Operate the vehicle, or permit it to be operated for the transport of more than the number of passengers or more than the weight of goods specified in the certificate of loading for the vehicle.
- Drive or permit the vehicle, to be driven by any person if at the time of his or her driving the vehicle, the hirer or other person is not the holder of a current drivers license appropriate to the vehicle.
RETURN OF VEHICLE
The hirer shall at or before the expiry of the term of hire deliver the vehicle to the owners agreed place of drop off or obtained the owners consent to the continuation of hire.
Once the hire period has commenced the hirer must contact by telephone to arrange and or confirm drop off time with Jupiter Campers.
Returns are to be made within the business hours of 9am – 4pm. Vehicle returns outside of these hours incur a late drop off fee of $200 and must be arranged with the owner prior to drop off.
IMMEDIATE RETURN OF VEHICLE WHERE DEFAULT OR DAMAGE
The owner shall have the right to terminate the hiring and take immediate possession of the vehicle if the hirer fails to comply with any of the terms of this agreement or if the vehicle is damaged. The termination of the hiring under the authority of this clause shall be without prejudice to the other rights of the owner and the rights of the hirer under this agreement or otherwise.
If the hirer fails to comply with any of the terms of this agreement and the hire is terminated by the Jupiter Campers, the hirer is not entitled to a refund in relation to any remaining days of the hire period.
DAMAGE
Any damage to the vehicle except minor body scratching must be reported to Jupiter Campers immediately. This report MUST NOT be left until the time the vehicle is returned.
TRAFFIC INFRINGEMENTS / CAMPING INFRINGEMENTS / PARKING INFRINGEMENTS
The hirer must pay any infringement fee and costs that may become payable because of an infringement notice served on Jupiter Campers for any toll, parking and/or any other traffic fines, infringements or violations incurred during the rental period. Jupiter Campers will complete a Statutory Declaration to transfer the infringement into the renter’s name or such other responsible person that you have advised to Jupiter Campers in writing is responsible for the fee or penalty.
Any toll, parking and/or any other traffic fines, infringements or violations incurred during the rental period or until such later time as the vehicle is returned to Jupiter Campers incurs an additional administration fee of $75 including GST per fine / infringement to cover the costs of processing.
The hirer authorise Jupiter Campers to debit the hirer’s credit card for an administration cost of $75 including GST per infringement notice received.
In the case of Jupiter Campers not being able to complete a Statutory Declaration for an infringement notice, the hirer authorise Jupiter Campers to debit your credit card for the amount specified on the notice and any fees or costs payable under this Agreement upon receipt of a reminder notice.
Jupiter Campers will send the hirer a copy of the infringement notice and Rental Vehicle Agreement.
The hirer has the right to challenge, complain about, query or object to the alleged offence to the issuing enforcement authority, and the right to seek a court hearing (within 56 days from the date of infringement).
